Your annual or day membership for the ‘Isle of Wight Mountain Bike Centre’ is appending to the terms and conditions.



Definitions 

The contract between you and us for the service provided. The terms and conditions will change from time to time.


Duration: 

  • An annual membership is valid from 30th March - 29th September 2024..

  • A day pass is valid for one day only. 


Fees: Membership passes, Day passes, Coaching, Clubs, Hire bikes.

Serivies: The use of the ‘Isle of Wight Mountain Bike Centre’.

Trading as: Isle of Wight Mountain Bike Centre Community Interest Company

Location: Cheverton Farm, Shorwell Shute, Newport, Isle of Wight, PO30 3JE.

Days open: Monday-Sunday


  1. BASIS OF ANNUAL MEMBERSHIP AND DAY PASS

1.1. Your offer for a day pass or annual membership is an offer by you to us where we can decline or accept your request.

1.2. These conditions will become bonding on you and us when we approve your annual membership or day pass.This will be done by giving you your annual membership card or your day pass receipt.  

1.3. You will receive a QR code when your booking is confirmed, use this when checking in at the mountain bike centre.


2. APPLICATION OF CONDITIONS AND OUR OBLIGATIONS 


2.1. These Conditions shall prevail over any inconsistent terms or conditions implied by law, trade custom, practice or course of dealing. This will not change your legal rights as a consumer.

2.2. The ‘Isle of Wight Mountain Bike Centre’ reserves the right to change minor aspects of the service. This will not change your legal rights as a consumer.

2.3. We will do all we can to be able to provide the service but you must acknowledge that our ability to provide the service may be affected by circumstances beyond our control.

2.4. Time is not of the essence for our performance of the services under the contract which means that you shall not be entitled to terminate the contract if we do not provide the service on time. 


 




Bookings

 Day passes and annual memberships can be purchased online through our website.

Day passes are £10 per day per rider. This covers you for one day's riding. 

Annual memberships are £65. The passes are valid from 30th March till 29th September 2024.

Security and Privacy 

No 3rd parties – your details are confidential and will not be passed to any third parties.

We do not hold your payment details on file, all sensitive information is processed via paypal and stripe, which are proven safe payment providers.

Booking Conditions

The contract for mountain biking and leadership courses is with the Isle of Wight Mountain Bike Centre and is the provider of the courses. These booking conditions, together with the information contained in the prospectus and the online booking, form the basis of your contract.


All possible care is taken to see that you have a happy and successful mountain bike skills course. The booking conditions below seek to explain as clearly as possible the responsibility undertaken between us when you make, and we accept, a booking:

1. To make a booking

All bookings can only be done through our website.

This booking must then be completed and signed by the person accepting the booking

conditions on behalf of all those named on the form. Both parties agree to submit to the

jurisdiction of the English Courts. Bookings are accepted at our discretion.

2. Our price policy

The prices given in the prospectus are the expected cost of the package described and will be confirmed when you make the booking. Once the booking has been confirmed in writing, we guarantee that we will not increase the price of your course.


3. If you cancel your booking:

Cancellations will only be accepted in writing from the person who signed the booking form. We can accept no responsibility for cancellation charges arising from correspondence delayed or lost in the post.

Should you be forced to cancel your booking, cancellation charges will be applied as follows:

Bookings will be refunded, minus a 20% charge of the course fee to pay the admin fees if the course is cancelled before 48 hours of course/club taking place. 48 hours or less no refund offered. 


4. If we cancel your booking:

We will only cancel your booking if one of the following take place:

i) due to unusual and unforeseeable circumstances beyond our control which could

not be avoided even with all due care having been exercised.

or

ii) Dangerous weather which could cause injury to customers and staff.

5. If we change your booking:

Circumstances may require some changes to be made at any time to the particulars of your skills course. Any such changes will be held to be of a minor nature. We will not materially change the value of the training course and the original theme will be retained.


6. Before you make a booking

Participants should be aware that cycling both on and off road is a potentially dangerous activity, and that they undertake the training course, coaching, and clubs at their own risk.

The provider shall not be responsible for participants’ actions or for injury, damage to property or other loss due to an inadequately serviced or maintained bikes or other personal equipment or any other matter beyond their control.

Before making a firm booking for the training course, intending participants MUST make certain it is appropriate to their physical abilities. In addition, pre-existing medical or mental conditions or learning or physical disabilities, whether or not these are controlled by medication or are currently dormant, must be declared before booking. The provider shall not be responsible if any participant is unfit for the training course. Any participant suffering from diabetes, asthma or any other condition requiring medication shall ensure that the provider is aware of this. It remains the responsibility of each participant to disclose the existence of such a medical condition. The provider will not be held responsible for any failure to do so.


7. Bookings are accepted on the following understanding:

The participant’s booking is accepted on the understanding that he or she realises the hazards involved in this kind of skills coaching including injury, loss of or damage to property including bikes, inconvenience and discomfort. The whole philosophy of this type of skills coaching is one that allows alternatives and requires a substantial degree of flexibility. The outline itineraries given for each session must therefore be taken as an indication of what is to be accomplished and not as a contractual obligation. Changes in itinerary may be caused by local conditions, mechanical breakdown, weather, sickness or other unforeseen circumstances. No refund will be given for services not utilised. It is a fundamental condition of joining the training course that a participant accepts the need for this flexibility and acknowledges that alterations and their results, such as inconvenience, discomfort or disappointment, are possible.

It is necessary that a participant abides by the authority of, and co-operates with, the organisers, and their agents/representatives. Signing the booking form signifies the participant’s agreement to this, and we reserve the right to terminate without notice the skills coaching arrangements of any participant who commits an illegal act when or whose behaviour is such that it is likely, or that of any accommodation owner or manager, or other person in authority, to cause distress, danger, damage or annoyance to other customers, employees, property or to any third party. In all cases we will be under no obligation whatsoever for any costs incurred, and the participant concerned shall not be entitled to any refund.





8. Our liability to you

We promise to ensure that all parts of the training course we have agreed to arrange as part of our contract are provided to a reasonable standard and in accordance with that contract. We accept responsibility for any personal injury or death caused to you as a result of the proven;-

negligent acts and/or omissions of staff, agents, suppliers and subcontractors. The

provider shall not be liable for any damages caused by the total or partial failure to carry out the contract if such failure is:

i) attributable to the participant or any member of his or her party,

or

ii) the fault of a third party unconnected to the provider

or

iii) a result of unusual or unforeseen circumstances beyond the control of the provider

or the supplier of the service in question which could not have been predicted or avoided even after taking all reasonable care

or

iv) the fault of any person who was not carrying out work for us (generally or in

particular) at the time.

Where the provider is found to be liable for damages in respect of its failure to carry out the

contract the maximum amount of such damages will be limited to the price paid for the training course. Where the damages relate to the provision of accommodation, any compensation payable will be further limited by the Paris Convention 1962. Any arrangements made by the participant that are not part of the training course are entirely at his or her own risk.

9. Should you have a complaint?

In the event of problems arising during the training course, participants should try to resolve directly with the staff, and/or their agents/representatives. If the problem cannot be

resolved at this time an incident report form will be completed, a copy of which will be given to you.

Complaints will be dealt with in accordance with the procedures of the provider under which the complaint will be investigated by a senior official from the club within a given timescale. Should an amicable solution not be agreed an appeal will be handled at committee level.


10. Special requests

Any special requests should be made known to Isle of Wight Mountain Bike Centre before the course is paid for. We do our very best to comply with these but we cannot guarantee they will be provided.

11. Force majeure

This is the term applied to unusual and unforeseeable circumstances that are beyond our control. Compensation payments do not apply to changes, cancellations or curtailment caused by reason of war, threat of war, riots, civil strife, terrorist activities, industrial disputes, natural or nuclear disaster, fire, adverse weather conditions, floods etc or similar events. We cannot accept responsibility where the performance or prompt performance of our contract with you is prevented or affected as a result of such circumstances.



12. Data Protection Act

In order to process your booking and ensure that your booking arrangements run smoothly, we need to use the information you provide such as name, address, any special needs/dietary requirements etc.

This information if required must be passed on to the relevant suppliers such as accommodation providers etc. We take full responsibility for ensuring that proper security measures are in place to protect your information whilst in our hands.


13. Marketing

Photographs, likenesses or images of participants secured or taken on any of our training

courses may be used by the provider without charge in all media for bona fide promotional or marketing purposes. 










Park Rules and Riders Code

Please follow the code to ensure fun and safety for all riders at the park. 

Isle of Wight Mountain Bike Centre staff reserve the rights to revoke day and season passes on the spot or ban riders from using the mountain bike centre if any of the centre's riding code are broken.

Ride within your ability! All the centre's trails are graded according to ability to ensure that you are competent to ride each trail. If in doubt, start on the easier trails and work your way up.

Take your time! Don’t assume you know the trails, even if you have been to the centre before. With constant use by riders, maintenance, and improvements, features can change over time.

Riders MUST NOT push or ride up the trails.

Do not stop on the trails. If you find it necessary to stop, pull off the trail in a safe place. NEVER BLOCK THE TRAILS!

When entering a trail or starting downhill, look up and give way to riders coming down/along the trails.

Stay on the marked trails at all times, never cut through corners or modify trails. 

When trails are CLOSED using red and white chains. DO NOT ride as this will result in your day pass or annual membership being revoked on the spot. 

Only ride the Isle of Wight Mountain Bike Centre when it is open during the riding season. (More information on our riding season can be found in the ‘RIDERS CODE’). If you do not abide by this rule then you will be banned from the centre for the upcoming year. The centre is run on private land and during our closed season the general public (you) are trespassing. 

Full face helmets are strongly recommended at the centre, but it is not compulsory. It is compulsory to wear well fitted, good quality helmets and knee pads whilst using the centre.

We also recommend you wear gloves, body armour, eye protection and a neck brace.

IF YOU DO NOT HAVE A GOOD QUALITY, WELL FITTED HELMET AND KNEE PADS YOU ARE NOT ALLOWED TO RIDE THE CENTRE THIS IS FOR YOUR SAFETY.

If a rider is hurt, do not attempt to move them. Inform a member of staff at the Isle of Wight Mountain Bike Centre. 

ALL INJURIES MUST BE REPORTED TO THE ISLE OF WIGHT MOUNTAIN BIKE CENTRE.

Footpaths and cycle routes are shared in some parts of the centre. As the cyclist it is your reasonability to pass walkers and dogs in safe manner. Signs are used to warn you of these areas.

Riders should always give way to walkers and plenty of warning must be given when approaching walkers. Find a safe place to pass people and animals using the paths/trails.

No responsibility is accepted by the organisers for any injury sustained or caused while using shared footpaths and bike trails.

It is your responsibility to make sure you and your equipment is fit for purpose.

If you are under the influence of drug or alcohol you are not permitted to use the mountain bike centre. There is a zero tolerance towards riding the centres trails when under the influence of drugs or alcohol.

All participants under the age of 18 must get a signed consent forum from their legal guardian. (Aged 18 or over). A parent or guardian must accompany riders aged 16 or stay onsite for the duration their child is riding.

The Isle of Wight Mountain Bike Centre does not take any responsibility for your bike set up. The ‘Bike Check List’ is just for reference and it is down to you to look after your own bike. It is also your responsibility to set your bike up properly. If you are unsure visit a local bike shop.











MOUNTAIN BIKING, LIKE ANY EXTREME SPORT, IS DANGEROUS, INCLUDES SUBSTANTIAL OBSTACLES, WHICH CAN BE PHYSICALLY DEMANDING.

THERE IS A RISK OF INJURY AND DEATH WHEN UNDERTAKING SUCH ACTIVITIES.







MOUNTAIN BIKE CHECKLIST

The trails at the Isle of Wight Mountain Bike Centre are demanding on riders and their bikes. Before riding your bike make sure you have fully checked it to make sure it is in full working order. Or you have had it checked by a professional mechanic. IF IN DOUBT, DO NOT RIDE!

We recommend you use full suspension bikes with hydraulic brakes and good quality gears.

All personal riding equipment must be fit for purpose and in good condition. There should be no cracks or dents in your helmet. There should be good padding lined inside your helmet and the strap must be in full working order so you can get your helmet secured on your head.

Inspect your bike is fit for purpose by checking for cracks, dents and general damage.

Check wheels are secured using the front and rear axle.

Check your headset is tight and secure.

Check your tires have plenty of tread and rims are in good condition. Look for cracks or splits in the tiers walls and treat area. Check your tires still have plenty of tread on them. Check your tires have pressure we advise in dry conditions 25 – 40 psi. In wet conditions 20 – 30 psi. This is your personal choice this is what our staff ride.

Check your seat post is secure and not loose.

Check your suspension is operating as it should (goes up and down). If you are unsure use one of the great local bike shops. Check your suspension isn’t leaking oil and check the amount of PSI in your forks and rear shock. Use the tables provided to check your weight to PSI range. This is just a suggestion from our staff. It’s your bike so set it up as you like. 

Check all bolts are tight on your bike.

Check your breaks. Check your brake pads to see how much pad is left until it wears down to metal. Check there is no oil leaking from the calliper, hose and lever. Go to a local bike shop if you are unsure on your breaks.

Check your discs are not bent, cracked or damaged in anyway.

Check the cockpit is secure and has no unwanted play in the handlebars, stem or headset. Check your grips are secured, check brakes and other handlebar mounted accessories are secured.

Check handlebars are straight with the wheel and you are able to move the handle bars with ease when the wheel is off the ground. If you are struggling to move the handlebars when off the ground then you have over tightened the centre bolt on top of your stem.

The Isle of Wight Mountain Bike Centre does not take responsibility for the set up of your bike. This is down to you. If you are not confident in setting up your bike the visit a local bike shop.


ACCEPTANCE OF RISK

YOU ARE ABOUT TO TAKE PART IN A HIGH RISK SPORT. ACCIDENTS DO HAPPEN! THE RISK CAN BE MINIMISED BY FOLLOWING OUR ‘RIDERS CODE’. IF YOU DO NOT FOLLOW THE ‘RIDERS CODE’ YOU ARE INCREASING THE RISK OF AN ACCIDENT THAT COULD BE FATAL.

I understand that mountain biking is dangerous and includes challenging obstacles, which can be physically testing. I accept that there is a risk of injury and death when undertaking such activities.

I understand that I must wear a good quality helmet and knee pads at all times. I also understand that the Isle of Wight Mountain Bike Centre highly recommend full face helmets, body armour, eye protection and gloves.

I agree at all times I will follow the ‘Riders Code’ when riding at the Isle of Wight Mountain Bike Centre. 

I agree I will check my bike and protective equipment as per the Mountain Bike Checklist before I ride at the centre, before each ride and after a crash.

In the unlikely event of an accident, loss or damage to my personal effects, I acknowledge that the Isle of Wight Mountain bike centre will not be liable for any direct or indirect loss, damage or injury arising from or connection with the activities. 

I certify that to the best of my knowledge I do not have a medical condition which might have the effect of making it more likely that I could be involved in an accident which could result in injury to yourself or others.

THESE TERMS COVER your booking, entry into the Isle of Wight Mountain Bike Centre and the use of the uplift, trails and hiring of equipment.

IT IS IMPORTANT YOU READ THESE TERMS CAREFULLY BEFORE BOOKING/RIDING this is because they provide important information of which you need to be aware before undertaking this sporting activity at the Isle of Wight Mountain Bike Centre. You must understand that the staff of the Mountain Bike Centre reserves the right to refuse you entry to the Centre.   1. Bookings and your contract with us

DAY PASSES – day passes will be accepted on the day but if you do not follow the ‘Riders Code’ then your pass will be revoked. This means you are not allowed to ride the Isle of Wight Mountain Bike Centre for the rest of the day even if you purchase another pass. If the rider breaks anymore ‘Riders Code’ then this will resolve in a season ban from the Isle of Wight Mountain Bike Centre.

SEASON PASSES – a season pass can take up to two weeks to be sent to the person who purchased it. This means you will need to keep a copy of your paypal receipt on you until you are given your season pass card. If the ‘Rider Code’ is broken at any point this will resolve in your card being revoked. You will be able to purchase another season pass but if the ‘Riders Code’ is broken again this will resolve in a ban for the remainder of the season.

  1.  Full centre closure and trail closure

Sometimes it is necessary for the centre to be closed for the whole day or a couple of months. We take no pride in closing the centre for any duration but it is imperative for safety reasons if we do close. The Isle of Wight Mountain Bike Centre will give as much notice as possible. The centre could close for some of the following reasons:

  • Shooting season – During the months between September and March it is shooting season on Cheverton Farm. This activity is very dangerous and the site must be closed for everyone’s safety. This is why the centre closes during the winter months. 

  • Shooting days during September - the shoot starts in September so the centre can be closed for the day. This activity is very dangerous and the site must be closed for everyone’s safety.

  • Bad Weather – We cannot control the weather so if there are strong wind’s, storm warnings or snow the Isle of Wight Mountain Bike Centre will need to shut for the duration of the bad weather. This is for your safety 

  • During races or events – The centre will be closed during events and races. The centre will only be open to the people competing in the race. If you are unsure when the centre will be open please get in touch at isleofwightmountainbikecentre@gmail.com .

  • Trail closures – Sometimes it is necessary for the centre to close a trail. This could be down to; fallen trees, maintenance or trail improvements.


ANYONE CAUGHT RIDING DURING A DAY OR PERIOD OF THE ISLE OF WIGHT MOUNTAIN BIKE CENTRE BEING CLOSED WILL BE BANNED FROM THE CENTRE FOR THE SEASON OR FOLLOWING SEASON. THIS INCLUDES RIDING TRAILS THAT ARE CLOSED.










 5. RESPONSIBILITY AND REQUIREMENTS

WE ARE RESPONSIBLE TO YOU FOR FORESEEABLE LOSS AND DAMAGE CAUSED BY US. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking this contract or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.  By signing the Participation & Risk Acceptance Form  you accept the risks associated with mountain biking. Mountain biking is a high risk activity and we cannot be responsible for any injury or damage to you or your property unless we have failed to use reasonable care and skill.

WE RECOMMEND THAT YOU TAKE OUT SUFFICIENT INSURANCE for personal liability and injury because of the high risk involved with mountain biking activities. You should contact a reputable insurer or insurance broker for advice as we cannot provide any advice or arrangement assistance on insurance policies.

WE DO NOT EXCLUDE OR LIMIT IN ANY WAY OUR LIABILITY TO YOU WHERE IT WOULD BE UNLAWFUL TO DO SO. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to your booking and for defective products under the Consumer Protection Act 1987.

WE ARE NOT LIABLE FOR BUSINESS LOSSES we only supply the services for domestic and private use. If you use Isle of Wight Mountain Bike Centre for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity. 

YOU WILL NOT BE PERMITTED TO USE ANY OF OUR SERVICES AND FACILITIES WITHOUT AGREEING TO THESE TERMS AND CONDITIONS. The agreement to the terms and conditions can be found before paying for Day and Annual passes. If you do not agree to these terms and conditions prior to arrival it can be made available for you to do so upon arrival. If you do not agree to the terms and conditions of this contract then you are not permitted to use the Isle of Wight Mountain Bike Centres facilities.






YOU MUST USE AND FOLLOW THE MOUNTAIN BIKE CHECKLIST, RIDERS CODE AND ADVICE OF OUR STAFF. Failure to comply could result in you being asked to leave the Park, you will not receive a refund and we reserve the right to charge you for any damage or injury caused as a result of any act by you or negligence.

VALID PHOTOGRAPHIC IDENTIFICATION (either passport or driving licence)  MUST BE SUPPLIED TO US AND WILL BE RETAINED BY US FOR THE TERM OF HIRE. no copies will be taken or information stored by us and the identification will be handed back to you when the hire is complete.

ALL EQUIPMENT HIRE MUST BE RETURNED AND WASHED. For full day and afternoon hire by 17:00.  The equipment must also be cleaned using our onsite wash facility each day of use.

IF YOU ARE LATE RETURNING YOUR BIKE you must pay a late returns fee of £10 for every 15 minutes over the return time.

b. UPLIFT AND TRAIL USAGE

YOU MUST FOLLOW THESE TERMS AND CONDITIONS, THE RIDERS CODE, THE ADVICE OF OUR STAFF AND, MOUNTAIN BIKE CHECKLIST AND CHECK YOUR BIKE PRIOR TO EACH USE. Failure to comply could result in you being asked to leave the Park and/ or banned from further entry, you will not receive a refund and we reserve the right to charge you for any damage or injury caused as a result of any act by you or negligence regardless of your act being intentional or unintentional.

CHILDREN UNDER 18 MUST HAVE THE WRITTEN CONSENT OF THEIR PARENT OR GUARDIAN  TO USE OUR SERVICES.

CHILDREN AGED 16 AND UNDER MUST HAVE A PARENT OR GUARDIAN (over 18) present with them at all time at the Park. The parent or guardian must also sign the Participation & Risk Acceptance Form on the child’s behalf.

CHILDREN UNDER 12 WILL ONLY BE ALLOWED TO USE OUR SERVICES BY PRIOR BOOKING which will be at our discretion.

   6. PRICE AND PAYMENT

HOW TO FIND OUT THE PRICE this is the price indicated on the order pages when you placed your order.

WHAT HAPPENS IF THE PRICE IS WRONG? Despite our best efforts there is a possibility that your booking could be incorrectly priced.  We will normally check prices before accepting your order so that, where the correct price at your order date is less than our stated price at your order date, we will charge the lower amount.  If the correct price at your order date is higher than the price stated to you, we will contact you for instructions before we accept your order.

WHEN YOU MUST PAY AND HOW YOU MUST PAY we accept payments with PayPal and all major cards. You must pay at the time of booking.

    7. COMPLAINTS

IF YOU HAVE ANY QUESTIONS OR COMPLAINTS please contact us as soon as possible using the details provided in 2. Above.  Alternatively please speak to one of our staff at the Park.

The Consumer Rights Act 2015 says:

·   you can ask us to repeat or fix a service if it's not carried out with reasonable care and skill, or get your money back if we can't fix it.

·   if you haven't agreed a price beforehand, what you're asked to pay must be reasonable.

·   if you haven't agreed a time beforehand, it must be carried out within a reasonable time.

    8. HOW WE MAY USE YOUR PERSONAL INFORMATION

WE WILL USE YOUR PERSONAL INFORMATION:

  1. or your booking

  2. or contact you where required in accordance with these terms, for example if we have to make changes or cancel your booking.

OUR PAYMENT DETAILS ARE NOT INPUT STORED BY US YOU WILL BE DIRECTED TO PAYPAL TO MAKE PAYMENT. PayPal will use your details to process payment and you must read and follow their terms and conditions. 

WE WILL ONLY GIVE YOUR PERSONAL INFORMATION TO THIRD PARTIES WHERE THE LAW EITHER REQUIRES OR ALLOWS US TO DO SO.

   9. OTHER IMPORTANT TERMS

WE MAY TRANSFER THIS AGREEMENT TO SOMEONE ELSE. We may transfer our rights and obligations under these terms to another organisation or person.  We will contact you to let you know if we plan to do this.  If you are unhappy about the transfer you may contact us to end the contract prior to 48 hours before your arrival and we will refund you any payments you have made in advance.

YOU NEED OUR CONSENT TO TRANSFER YOUR RIGHTS TO SOMEONE ELSE. You may only transfer your rights or your obligations under these terms to another person if we agree to this prior to 48 hours before your booking day of arrival.

NOBODY ELSE HAS RIGHTS UNDER THIS CONTRACT. This contract is between you and us. No other person shall have any rights to enforce its terms.

IF A COURT FINDS PART OF THIS CONTRACT ILLEGAL THE REST WILL CONTINUE IN FORCE.  Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.

Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you damage our property and we do not pursue you we may still pursue you at a later date.

These terms are governed by English law and you can bring legal proceedings in the English courts. If you live in Scotland you can bring legal proceedings in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
